Where planetary boundaries and legal boundaries coincide

I write as the world holds its breath awaiting the results of the election in the USA. Whoever wins, there will be significant consequences for legal regulation of many details of the physical and living world; whatever regulatory policies are pursued will affect greenhouse gas (GHG) levels, environmental pollution, biodiversity, marine ecosystems and all aspects of our planetary home. Thinking about climate change, biodiversity loss and connected destabilisation is terrifying. Nonetheless, increasing numbers of lawyers and activists are dealing with...

BSB publishes Regulatory Action Diversity Analysis Report

The BSB has today published research analysing the outcomes of reports regarding barrister conduct received and processed1 by the BSB. By reports, we mean concerns about the conduct of a barrister that are reported to us. This research details how likely barristers are to be subject to a report, with a particular focus on the characteristics of ethnicity and gender. In October 2019, the BSB introduced reforms to the enforcement process. The report also aims to assess the impact of these reforms, with a particular focus on how they have impacted on outcomes by gender and ethnicity. It is a follow up to two previous research reports on BSB reports processing from 2015-2019, and 2011-2014. The...

The Rise of the English Jurisdiction as Europe’s Leading Venue for Arbitration Award Enforcement Against Recalcitrant EU States.

In the grand tradition of British legal fortitude, one cannot help but acknowledge the unbeatable supremacy of London in enforcing arbitration awards against the sometimes capricious EU member states in the international scenario. It is an irony, indeed, that while our continental brethren embroil themselves in bureaucratic entanglements and juridical contortions, London remains an unassailable stronghold of legal integrity and reliability. Nowhere is this more evident than in the context of arbitration awards, where the English courts stand unmarred...
